This Privacy Policy governs the manner in which ChaosMonkeys, Inc and ProfGMedia. (“ProfGMedia,” “ProfG, ” “we,” or “us”) collect, use, maintain and disclose information collected from users (a “user,” as well as “you,” “your” and similar terms) through our websites at profgmedia.com and profgalloway.com, as well as any other online services that we operate and that link to this Privacy Policy (collectively, the “Online Resources”).
By using the websites or any of the Online Resources, you agree to the collection, use, and disclosure of your information as described in this Privacy Policy. If you do not agree to this Privacy Policy, please do not use or access the websites or the Online Resources.
What Information Do We Collect and How Do We Collect It?

How Do We Use Your Personal Information?

Third-Party Activity

We are not responsible or liable for the accuracy of the information provided to us by third parties and are not responsible for any third party's policies or practices. The information practices and privacy policies of these parties may be different than ours. We are not responsible for any actions or omissions by these third parties. Our inclusion of such links does not, by itself, imply any endorsement of the content on such platforms or of their owners or operators, except as disclosed on our Online Resources.
Business Transitions. We reserve the right to disclose and transfer all user information: (a) to a subsequent owner, co-owner, or operator of the Online Resources or applicable database; or (b) in connection with a merger, consolidation, restructuring, the sale of substantially all of our interests and/or assets or other corporate change, including during the course of any due diligence process.
Cookies and Similar Technologies
We also collect information through cookies and similar technologies, including pixels, web beacons, tags, and scripts.
A cookie is a small text file that a web server places on a device (such as your computer or smartphone) when it is used to visit our Online Resources. The information stored in cookies may be returned to our servers or to the servers of relevant third parties during a subsequent visit.
Pixels are small images on a web page or in an email. Pixels collect information about your browser or device and can set cookies on your browser.
A web beacon (or a pixel tag) is a small, invisible piece of text or image on a website that is used to monitor traffic on a website. In order to do this, various data about you is stored using web beacons.
A script is a piece of program code that we use to make our websites function properly and interactively, which is executed on our server or on your device.
We and third parties we have engaged may use cookies and similar tracking technologies to access or store information, as well as to optimize the website experience for our users and to ensure that certain parts of our Online Resources are working properly. Do You Retain and Delete My Data?
We strive to retain your Personal Information only for as long as necessary to fulfill the purposes for which it was collected and processed, including for the purposes of satisfying any legal, regulatory, accounting, or reporting requirements, subject to applicable law, and that any Personal Information is fully deleted from our systems when no longer required.

Please note that we reserve the right to send you certain communications relating to use of our Online Resources, such as administrative and service announcements, and these messages may be unaffected if you choose to opt-out from receiving our marketing communications. Children’s Data
The online resources are not intended nor designed to attract users under the age of 17. We do not knowingly collect any Personal Information from children younger than the age of 17. We will delete any Personal Information collected that we later determine to be from a user younger than the age of 17. Information Regarding Do Not Track Signals and Collection of Personally Identifiable Information for Third-Party Advertising
Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. We do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online.
We do not authorize the collection of Personal Information from our users for third-party use through advertising technologies.
What Are My Rights Regarding My Personal Information?
Depending on where you live, you may have some or all of the rights listed below in relation to your personal information. However, these rights are not absolute, may apply only in certain circumstances and, in certain cases, we may decline your request as permitted by law.
- Right to Access/Know: You may have the right to request an accounting of all Personal Information that we have that pertains to you, and to be delivered copies of such information in electronic format (e.g., electronic copies of information attached to an email). We reserve the right to transmit information to you in a manner that complies with all applicable laws.
- Right to Correct: You may have the right to request that we change any Personal Information that pertains to you that is inaccurate.
- Right to Delete: You may have the right to request that we delete some or all Personal Information that pertains to you. We reserve the right to carry out such a request in a manner that complies with all applicable laws, such as laws concerning record retention. Note that fulfilling this request requires us to delete Personal Information in our possession, but that this right does not extend to Personal Information that has already been lawfully shared in accordance with this Policy.
- Right to Opt Out of Sale or Sharing or Targeted Advertising: You may have a right to direct us not to "sell" or "share" your Personal Information or to opt out of the processing of your Personal Information for purposes considered to be "targeted advertising", as defined in applicable privacy laws. - Restriction of Processing: You may have the right to request that we cease processing any Personal Information that pertains to you. Note that fulfilling this request requires us to cease processing Personal Information that pertains to you in the future, but does not apply to lawful processing that has already occurred in accordance with this Policy.
- Right to Non-Discrimination: You have the right to exercise all the rights afforded by this Policy without fear of retaliation or discrimination. This means that we treat Users who exercise any of the rights under this Policy the same as Users who do not.
California Civil Code Section 1798.83, also known as the "Shine The Light" law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of Personal Information (if any) we disclosed to third parties for direct marketing purposes, and the names and addresses of all third parties with which we shared Personal Information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us using the contact information provided below.

Once we have received notification that you withdraw your consent, we will no longer process your information for the purpose(s) to which you originally consented unless there are compelling legitimate grounds for further processing which override your interests, rights and freedoms or for the establishment, exercise or defense of legal claims.
For users within the European Union, we transfer data from the EU to data centers located in the United States for processing, pursuant to your consent as indicated when requested. Such processing is performed in accordance with the GDPR. This includes the imposition of required safeguards with respect to accidental, unauthorized or unlawful destruction, loss, alteration, disclosure, access, use or processing of data. If you are a resident of the EU and believe that we have misused your personal data, you also have a right to lodge a complaint with a national Data Protection Authority. Will This Policy Change?
We reserve the right, at our discretion, to change, modify, add, or remove portions of this Privacy Policy at any time. Your continued use of the Online Resources following the posting of revisions to this Privacy Policy will be deemed your acceptance of such revisions. We encourage users to frequently check the email account that they use in connection with the Online Resources, as well as this Privacy Policy, to stay informed about any changes to this Privacy Policy. Miscellaneous
This Privacy Policy will be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, USA, without regarding to conflicts of law principles. To the extent any provision of this Privacy Policy is found by a competent tribunal to be invalid or unenforceable, such provision shall be severed to the extent necessary for the remainder to be valid and enforceable.
